Drugs Under Texas DWI Law

Under Chapter 49 of the Texas Penal Code, “intoxicated” is defined as not having the normal use of mental or physical faculties because you are under the influence of alcohol, a controlled substance, a drug, a dangerous drug or a combination of those substances. It is also defined as having a blood alcohol concentration of 0.08 or more.

The synergistic effect of multiple drugs. When drugs are combined with alcohol, the effects can be significant, leading to impaired driving even when it is unintentional and unexpected.
