In Texas, offenders under 21 years of age may face severe consequences when they are arrested for driving after allegedly consuming alcohol. Depending on the circumstances and the alleged level of intoxication, they may be charged with either DUI or DWI.

Zero Tolerance for Minor DUI

Texas is a “zero tolerance” state for people under the age of 21. Under Texas law, minors have committed a DUI if they have any detectable amount of alcohol in their systems while operating a motor vehicle. This offense is a class C misdemeanor. Punishments for a minor’s DUI may include fines, alcohol education courses, community service and, if other circumstances apply, even confinement in jail.

If a minor is convicted of driving with a blood alcohol level of more than 0.08, the offense is considered DWI.
