Texas Drunk Driving Law – Chapter 49 of the Texas Penal Code

Under Texas law, being intoxicated is defined as not having the normal use of mental or physical faculties because you are under the influence of alcohol, a controlled substance, a drug or a combination of those substances. It is also defined as having a blood alcohol concentration of 0.08 or more.

What Does 0.08 Really Mean?

In Texas, you can be charged with drunk driving if you were driving with a blood alcohol concentration of 0.08 or more. But what does that mean? It means that for every 210 liters of breath (or 100 milliliters of blood or 67 milliliters of urine), you had 0.08 grams of alcohol according to the Breathalyzer test.
